1. Introduction

This Privacy Policy applies to all users of Neatcar and Neatcover services, including our website, mobile applications, and all other digital platforms operated by Groupe Neatcar Inc. (hereinafter "Neatcar", "we", "us" or "our").

By using our services, you acknowledge that you have read this Policy and consent to its terms. If you do not accept these terms, please stop using our services.

Neatcar is subject to Quebec's Act respecting the protection of personal information in the private sector (Law 25), Canada's Anti-Spam Legislation (CASL), and any other applicable privacy laws.

3. Personal Information Collected

We collect only the information necessary for the purposes described in this Policy, namely: identity information (first and last name, date of birth if required), contact information (email, phone number, mailing address), payment data transmitted directly to our payment processor (Neatcar does not store full credit card numbers on its own servers), service-related information (vehicle details, transaction history, Neatcover insurance submissions), and technical information (IP address, browser type, pages visited, geolocation data).

We do not collect sensitive information such as health data, political opinions, or union membership, except where required by law.

4. Purposes of Processing and Legal Bases

We process your personal information only for specific purposes, each based on an identified legal basis in accordance with Law 25. The provision of our services and payment processing are based on the performance of a contract. The improvement of our services is based on our legitimate interest. Marketing communications are based on your prior express consent, in accordance with CASL. Profiling and experience personalization are also based on your express consent, as required by section 12.1 of Law 25. Legal and regulatory compliance is based on our legal obligations.

5. Automated Decisions and Profiling

Our services use profiling tools to personalize your experience and analyze the use of our platforms. By creating an account, you expressly consent to the use of these tools. This consent is a required condition to use our services. If you no longer wish to be subject to this, you must delete your account by contacting our Privacy Officer at privacy@neatcar.com. No decision having a legal effect or significant impact on you is made solely on the basis of automated processing without human intervention.

6. Your Rights

In accordance with Law 25, you have the following rights: access to your personal information, rectification of inaccurate or incomplete information, erasure of your information when it is no longer necessary (subject to our legal retention obligations), portability of your data in a structured format, withdrawal of consent resulting in the deletion of your account, and objection to profiling or automated decision-making.

To exercise any of these rights, contact our Privacy Officer at privacy@neatcar.com. We will respond to your request within 30 days of receipt, as required by Law 25.

7. Retention and Destruction of Information

We retain your personal information only for as long as necessary for the purposes for which it was collected. Account information is retained for 10 years after account closure. Financial and payment data is retained for 10 years. Transaction history is retained for 10 years. Marketing consent records are retained for 10 years. Technical data (logs, IP addresses) is retained for 10 years. Geolocation data is retained for 10 years. After these periods, information is securely destroyed or irreversibly anonymized.

8. Sharing with Third Parties and Cross-Border Transfers

We may share your information with third-party service providers solely for the purpose of providing our services, including payment processors, insurance broker partners, cloud infrastructure providers, and analytics tool providers. The complete list is available upon request from our Privacy Officer. Neatcar does not sell, rent, or transfer your personal information to third parties for commercial purposes.

When information is transferred outside Quebec, we conduct a Privacy Impact Assessment (PIA) and put in place appropriate contractual clauses to ensure a level of protection equivalent to that required by Law 25.

9. Use of Technologies (Cookies, Geolocation, Profiling)

Our platforms use cookies, geolocation tools, and profiling software. These technologies are enabled by default as part of the use of our services. By creating an account, you expressly consent to their use. If you no longer wish to be subject to them, you must delete your account by contacting our Privacy Officer at privacy@neatcar.com.

10. Marketing Communications

We send marketing communications only with your prior express consent, in accordance with CASL. You may unsubscribe at any time via the unsubscribe link in any commercial email, by contacting us at privacy@neatcar.com, or by updating your preferences in your account settings. Your request will be processed within 10 business days. Transactional communications (order confirmations, receipts, service notices) are not subject to this rule.

11. Security Measures

We implement technical and organizational measures to protect your personal information, including encryption of data in transit and at rest, strict access controls, regular security audits, staff training, and segregation of payment data processed by PCI-DSS certified providers.

12. Privacy Incidents

In the event of an incident likely to cause serious harm, Neatcar commits to promptly notifying the Commission d'accès à l'information du Québec (CAI), informing affected individuals as soon as the situation requires, logging the incident in a register as required by Law 25, and implementing appropriate corrective measures to limit consequences and prevent future incidents.

13. Protection of Minors

Our services are not intended for persons under 18 years of age. We do not knowingly collect personal information from minors under 18 without the consent of a parent or legal guardian. If you believe a child has provided us with personal information without your consent, contact us at privacy@neatcar.com and we will delete it promptly.

14. Changes to This Policy

We reserve the right to modify this Policy at any time. For significant changes, we will notify you by email at least 30 days before they take effect and by a notice on our website. For changes requiring new consent, we will expressly request your agreement before applying them.
