These Terms and Conditions (hereinafter "the Terms") govern the use of Neatcar and Neatcover services, including our mobile application, website, and all other digital platforms operated by Groupe Neatcar Inc. (hereinafter "Neatcar", "we", "us" or "our").
By creating an account or using our services, you acknowledge that you have read, understood, and accepted these Terms in their entirety. If you do not accept these Terms, you may not use our services.
Application: the Neatcar mobile software available for download on the Apple App Store or Google Play Store. Account: the unique account created by you to access our services. Company: Groupe Neatcar Inc., 121 av de l'Église, Saint-Sauveur (Quebec) J0R 1R4, Canada. Device: any device that can access the service (phone, tablet, computer). Service: all services offered by Neatcar and Neatcover via the Application and website. Subscription: access to services offered on a recurring and periodic basis. You: the individual or legal entity accessing the services. Car Wash Code: a digital code providing access to a car wash service at a partner location.
Our services are reserved for individuals aged 18 and over. By creating an account, you represent that you are at least 18 years of age. Neatcar reserves the right to suspend or terminate any account whose holder does not meet this requirement.
To use our services, you must create an account by providing accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your password and for all activities carried out under your account. You must notify us immediately of any unauthorized use of your account at info@neatcar.com.
By creating an account, you expressly consent to our Privacy Policy, including the use of profiling technologies, geolocation tools, and cookies, which are enabled by default as part of the provision of our services. This consent is a required condition to use our services. If you no longer wish to be subject to them, you must delete your account.
The collection, use, and retention of your personal information are governed by our Privacy Policy, which forms an integral part of these Terms. By accepting these Terms, you also accept our Privacy Policy. We encourage you to read it carefully.
In accordance with Quebec's Act respecting the protection of personal information in the private sector (Law 25), you have the following rights: access to your personal information, rectification of inaccurate or incomplete information, erasure of your information when it is no longer necessary (subject to our legal retention obligations), portability of your data in a structured format, withdrawal of consent resulting in the deletion of your account, and objection to profiling or automated decision-making.
To exercise any of these rights, contact our Privacy Officer at privacy@neatcar.com. We will respond within 30 days of receiving your request.
We retain your personal information for the following periods: account information for 10 years after account closure, financial and payment data for 10 years, transaction history for 10 years, marketing consent records for 10 years, technical data for 10 years, and geolocation data for 10 years. These retention periods are justified by our legal and tax obligations as well as fraud prevention requirements. After these periods, information is securely destroyed or irreversibly anonymized.
Some services are available only with a paid subscription. You are billed in advance on a recurring basis according to the period selected at the time of subscription. At the end of each period, your subscription automatically renews under the same conditions unless you cancel before the renewal date.
Neatcar reserves the right to modify subscription fees at any time. Any price change will be communicated to you by email with reasonable notice before the new rate takes effect, giving you the opportunity to cancel your subscription if you wish. Continued use of the service after the new rate takes effect constitutes acceptance of the modified fee.
You may cancel your subscription at any time through your account settings or by contacting us. No refund will be issued for the current subscription period. You will retain access to the service until the end of the paid period.
Car wash codes are non-refundable and non-transferable. Neatcar acts as a reseller only and has no control over the quality, execution, or safety of services provided by partner stations or any other third-party provider accessible through our platform.
Neatcar cannot be held responsible for any damage whatsoever arising from the use of services sold through our platform, including without limitation physical damage to the vehicle, mechanical or cosmetic damage caused during a wash, incidents occurring on a partner station's premises, loss of personal belongings, or any other direct or indirect harm related to the use of a third-party service.
By using a car wash code or any other service accessible through Neatcar, you acknowledge and accept that any recourse in the event of a problem is to be exercised directly against the relevant service provider, and not against Neatcar. In the event of a problem, we nonetheless encourage you to notify us at info@neatcar.com so that we can follow up with the partner concerned.
Purchases made through our services are subject to a one-time or recurring payment depending on the type of service. We accept major credit and debit cards (Visa, Mastercard, American Express) as well as other payment methods available on our platform. All amounts are in Canadian dollars (CAD).
Your payment card is subject to validation and authorization by your card issuer. If authorization is not obtained, we are not responsible for any delay or non-delivery of the service.
Paid subscription fees are non-refundable, except as otherwise required by law. Certain refund requests for subscriptions may be reviewed by Neatcar on a case-by-case basis at its sole discretion. Car wash codes are non-refundable.
Neatcar reserves the right to refuse or cancel any order in the event of a pricing error, service unavailability, or suspicion of fraud or unauthorized transaction. If your order is cancelled after payment, a full refund will be issued within 14 days using the same payment method used at the time of purchase.
We may offer a free trial period for certain subscriptions. The terms of the free trial will be specified at the time of the offer. Upon expiration of the free trial period, your subscription automatically converts to a paid subscription unless you cancel before the end of the trial period.
Promotions available through our services may be governed by specific rules communicated at the time of the offer. In the event of a conflict between the rules of a promotion and these Terms, the promotion rules will apply.
Referral codes are intended solely to invite new users. It is strictly prohibited to use a referral code to grant yourself a discount. Any misuse may result in the suspension or termination of your account.
The service, its original content, features, and appearance are and will remain the exclusive property of Groupe Neatcar Inc. and its licensors. Our trademarks and trade dress may not be used in connection with any third-party product or service without our prior written consent.
In the event of a privacy incident likely to cause serious harm, Neatcar commits to promptly notifying the Commission d'accès à l'information du Québec (CAI), informing affected individuals as soon as the situation requires, logging the incident in a register as required by Law 25, and implementing appropriate corrective measures to limit consequences and prevent future incidents.
To the fullest extent permitted by applicable law, Neatcar's total liability to you for any damages arising from the use or inability to use our services is limited to the amount you have actually paid to Neatcar in the 12 months preceding the event giving rise to the claim, or 100 CAD if no payment has been made.
Neatcar shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, loss of data, or service interruption, even if Neatcar has been advised of the possibility of such damages.
We reserve the right to modify these Terms at any time. For significant changes, we will notify you by email at least 30 days before they take effect and by a notice on our website or application. For changes requiring new consent, we will expressly request your agreement before applying them.

If you are not satisfied with our response, you may file a complaint with the Commission d'accès à l'information du Québec (CAI): www.cai.gouv.qc.ca, 1 888 528-7741.
These Terms are governed by the laws of the province of Quebec and the applicable federal laws of Canada. Any dispute arising from these Terms will be subject to the exclusive jurisdiction of the courts of Quebec.
These Terms are drafted in French. In the event of a version in another language, the French version prevails at all times in accordance with the Charter of the French Language.
